<p>Bankruptcy is the section of federal law that allows persons in extreme amounts of debt to get a &#8220;fresh start&#8221; by reducing the amount of debt required to be paid as well as extending the time period in which it must be paid. The bankruptcy laws are popularly referred to by their chapter number which corresponds to the relevant chapter of the Bankruptcy Code. There are five different chapters debtors may file under, three of which are for individuals: Chapter 7 Liquidation, Chapter 11 Reorganization, and Chapter 13 Reorganization.</p>
<p><strong>How do Bankruptcy Attorneys Solve Credit Problems?</strong></p>
<p>Bankruptcy lawyers explain the primary purposes and applications of bankruptcy laws and how they function to relieve individuals and businesses from indebtedness and provide a fresh financial start. Title 11 of the United States Code (the bankruptcy code) regulates the bankruptcy proceedings, including what chapter under which a debtor may file, what bills can be eliminated, how long payments may be extended, what possessions can be kept, and all other details concerning the bankruptcy.</p>
<p><strong>Bankruptcy Proceedings</strong></p>
<p>Bankruptcy attorneys practice two basic types of bankruptcy proceedings: liquidation under Chapter 7, and debtor rehabilitation involving a court-approved plan of reorganization and payment of the debts over a period of time using future earnings under Chapters 9, 11, 12 and 13.</p>
<p>The following provides general information on the five chapters of bankruptcy under which a debtor may possibly file:</p>
<p>Chapter 7:</p>
<p>Informally called &#8220;straight bankruptcy,&#8221; Chapter 7 is a liquidation bankruptcy proceeding. The debtor turns over all non-exempt property (assets) to the bankruptcy trustee who then converts it to cash for distribution among the creditors. At the end of the proceeding the debtor receives a discharge of indebtedness (discharge notice) for all dischargeable debts, releasing him or her from personal liability for those debts.</p>
<p>Chapter 9:</p>
<p>Also known as &#8216;Adjustment of Debts for a Municipality,&#8217; Chapter 9 is a federal mechanism for the resolution of municipal debts passed by Congress about 60 years ago. This form is similar to reorganization under Chapter 11, but it&#8217;s only available to municipalities. Municipalities include cities and towns, as well as villages, counties, taxing districts, municipal utilities, and school districts.</p>
<p>Chapter 11:</p>
<p>Also known as &#8216;Reorganization,&#8217; Chapter 11 is normally the chapter under which commercial enterprises (businesses) or their lawyers file. This allows the business to continue its operations while repaying creditors concurrently through a court-approved plan of reorganization.</p>
<p>Chapter 12:</p>
<p>Also known as &#8216;Adjustment of Debts of a Family Farmer with Regular Annual Income,&#8217; Chapter 12 provides debt relief to family farmers. Chapter 12 proceedings are very similar to those of Chapter 13 where the debtors or their lawyers propose a plan to repay debts over a period of up to three years, unless the court approves a longer period, no more than five years.</p>
<p>Chapter 13:</p>
<p>Also known as &#8216;Adjustment of Debts of an Individual with Regular Annual Income,&#8217; Chapter 13 provides debt relief for individuals or consumers. Chapter 13 differs from Chapter 7 in the respect that it enables the debtor to keep valuable assets, like a house, while making payments to creditors (through the trustee) based on the debtor&#8217;s anticipated income over the life of the plan, usually three to five years. At a confirmation hearing, the court either approves or disapproves the plan, depending on whether the plan meets the Bankruptcy Code&#8217;s requirements for confirmation.</p>

The reasons for hiring an accountant are pretty obvious&#8211;you need someone to help you set up your &#8220;chart of accounts,&#8221; review your numbers periodically, and prepare all of your necessary federal, state and local tax returns. The reason for hiring a Wichita business attorney may not, however, be so apparent. A good business attorney will provide vital assistance in almost every aspect of your business, from basic zoning compliance and copyright and trademark advice to formal business incorporation and lawsuits and liability. First, some general rules about dealing with lawyers:</p>
<p>* If you are being sued, it&#8217;s too late. Most small businesses put off hiring a lawyer until the sheriff is standing at the door serving them with a summons. Bad mistake. The time to hook up with a good business lawyer is before you are sued. Once you have been served with a summons and complaint, it&#8217;s too late&#8211;the problem has already occurred, and it&#8217;s just a question of how much you will have to pay (in court costs, attorneys&#8217; fees, settlements and other expenses) to get the problem resolved.</p>
<p>America&#8217;s judicial system is a lot like a Roach Motel&#8211;it&#8217;s easy to get into court, but very difficult to get out once you&#8217;ve been &#8220;trapped.&#8221; Most lawyers agree that while nobody likes to pay attorneys&#8217; fees for anything (heck, let&#8217;s let our hair down&#8211;nobody likes paying or dealing with lawyers, period), but the fee a lawyer will charge to keep you out of trouble is only a small fraction of the fee a lawyer will charge to get you out of trouble once it&#8217;s happened.</p>
<p>* Big firm or small firm? Generally speaking, the larger the law firm, the greater the overhead, therefore the higher the hourly rates you will be expected to pay. Still, larger firms have a number of advantages over smaller ones. Over the past 20 years, lawyers have become incredibly specialized. If you use a solo practitioner or small firm as your lawyer(s), it&#8217;s likely that they will not have all the skills you may need to grow your business. I don&#8217;t know of any solo practitioner, and very few small firms (under 10 lawyers) that could handle your lawsuits, negotiate your lease of office or retail space, file a patent or trademark, draft a software license agreement, advise you on terminating a disruptive employee, and oversee your corporate annual meeting. Sooner or later, these &#8220;generalists&#8221; will have to refer you out to specialists, and you will find yourself dealing with two or three (or even more) attorneys.</p>
<p>While larger firms are more expensive to deal with, they have two significant advantages: 1) they usually have all the legal skills you need &#8220;under one roof,&#8221; and 2) they have a lot of clout in the local, regional and (perhaps) national legal community. A nasty letter from a &#8220;powerhouse&#8221; law firm with offices in 30 states is a lot more intimidating than a nasty letter from a solo practitioner who is not admitted to practice in the defendant&#8217;s state. Also, being connected with a large, well-established law firm may have intangible benefits&#8211;they may be willing to introduce you to financing sources or use their name as a reference when seeking partnership arrangements. Certainly if you run a fast-growing entrepreneurial company that plans to go public (or sell out to a big company) some day, you would need to work with lawyers whose names are recognized in the investment banking and venture capital communities.</p>
